WA DFI Needs your info

To all you Znetix/HMC investors, here’s the real scoop:

· Those who received the letter from KL requesting investor info (WA securities div) get it filled out and sent in ASAP. It’s just the opposite of what everyone is thinking. You’re not reporting thus the delay. The longer you wait the longer the investigation is prolonged. The Department of Financial Institutions (DFI) has to hear from every investor before their investigation can be completed. You can help speed the process by: 1) supplying them with the requested information in writing, and 2) telling all the other investors you know to do the same. The DFI has limited manpower and if they have to call all the investors for the needed info then it will be at least two years before the investigation is complete.

· There will be no IPO until the investigation is complete.

· For accurate up-to-date information on this investigation see the DFI web site www.wa.gov/dfi/securities/.

· WA DFI enforcement attorney indicated in SDO 26-01 that it was illegal to sell these unregistered stocks. Again, reference the above web site. SEC rules say, a company is required to provide potential investors with a prospectus, etc. up front when selling stock.

· If you are comfortable with your investment, you can elect to keep the stock or you have the right to request (in writing to HMC) your money back, plus interest. If they refuse then report it to DFI and/or in your investor report. As far as DFI is concerned you gave your money knowing the risk unless they hear otherwise.

A good website to read about how to research and buy stocks and how the IPO process works is www.fraudbureau.com/investor/ipo

I am neither a basher nor cheerleader. I came to this bb looking for information. Unfortunately, between the b’s and c’s I’ve gleaned nothing.

Our firm represents HMC and is moving forward with a full and intensive legal action against all those that are trying to improperly cause harm to the company. This suit will include any person or entity that is party to divulging of proprietary information of the companies and/or publishes defamatory comments or accusations. With the assistance of local counsel, we will be serving subpoenas on several key individuals in the Sequim and Port Angeles, Washington areas that are known to have affiliations with these posters.

Anyone who has been contacted by former employees of Znetix and/or HMC with alleged "inside" or "confidential" information, please contact our office. Also, please contact us immediately with any knowledge you have of those individuals that are posting under aliases.

Yes indeed me and nort did have a private conversation via instant messanger and what I was trying to explain in the short space available was that since there is an AZ law firm involved I was going to take some of the post and those being DIRECT THREATS made to me to me. THE RECORDED CONVERSATIONS..ARE.. MESSAGES LEFT ON MY ANSWERING MACHINE LEFT BY IR ONE IN FEB... THE OTHER IN MARCH.... very simple...I went back and explained to Nort after I watched the NASCAR race...... after I sent an instant message there was NO reply and the race started.....during that time he sent one. I have NO reason to be on pins and needles but since NORT didn't get all of the story and posted I knew I had to clarify the rest. IF HMC wants to let their attorneys what is going on then why can't I let mine know? geez

I will start by saying "I am a long term HMC investor". I have been watching this board since posts in the 100's. I have mostly sat back amused. (Sometimes disgusted at how low some of my fellow investors have sunk) I am extremely positive about this investment. I am greatful to Nortie for taking the helm (with the help of several others) and starting to turn this ship (of negative bashing) around and move in a positive direction. I seems we have now turned the corner. What a welcome breath of fresh air!!

I have quietly read all the partial truths & scare tactics posted by T4Y and jplossi. I still can not reconcile why they have so much resolve to run this into the ground. It was sometimes hard to tell if their posts were really cautious concern or just rabble rousing BS. At times I actually thought that they might know something. Then this post #2287 showed up over the weekend.

Post 2287 08/11/01 01:21pm by jplossi "If I told you who Rick Sato I would just get blasted from others on this board.
Why don't we let others who are tied in directly with Znetix and HMC answer your question.
I can tell you that he is an intricate part of your investment and also lives here on Bainbridge Island.
Hint: He might have something to do with the overseas rumor that was floating around and it is not China, but close.
Anyone on this board aware of this besides me?"

It has convinced me beyond ANY doubt that they are totally blowing smoke and trying to cause trouble. I'm a friend of Rick's. I know his family and where he lives. I will not say where that is, but, IT IS NOT NOW, NOR HAS IT BEEN, ON BAINBRIDGE ISLAND. Do not believe anything jplossi has to say, he knows nothing. He is just trying to scare you and cause unrest!!!!

Only time will tell where and when this investment goes. As I've said I remain very positive. I hope all others involved will feel more confident now that the bashing has stopped. And some of the bashers dicredited.

again, I Be Pro Z

First of all I only cussed at those that cussed at me first. And the fact that the AZ firm made a post doesn't bother me why should it? I always made my posts DIRECTLY AT ITINKFORMYSELF2002, and I made it clear when she/he started his/her crap. EVERYONE is entiled to his/her opinion, I was NOT sworn under otath, signed a declaration nor anything. I heard your views and you heard mine if you liked some of them great; if you didnt like some of them then so be it. I believe they are called points of view...... but I never said ANYTHING about off-shore accounts, bank-accounts, KL's personal live etc...... I DID say I was investor and that I wanted this to be a good thing. I will however not kiss anyone's butt and not ask anyone to kiss mine I believe that to be fair. And when I made the reference to IR saying that the STATE will go away when we got the recission letter/pacakage I took it as great news and YOU took the liberty of PRINTING IT and SENDING it PER SAY YOU as if it made a difference (which it doesn't & won't) I have read the post from both boards and have posted from time to time but I will not have ANYONE dictate to me what I CAN or CANNOT do. I am sorry if this bothers you and you should not assume that i have done an about face because you don't know me. And you speak of creditability when we are in a room under oath speaking of knowledge that one is an expert on than we can question ones creditability but NOT until then!!!

Defamation Lawsuit
by: azlaw2001 08/15/01 08:22 pm
Msg: 2417 of 2427

As noted in our previous post (#2288), this law firm represents HMC. With the assistance of our local counsel in Seattle, we are continuing to push forward with a full and intensive legal action against those persons improperly causing harm to the company by either posting defamatory comments or by divulging proprietary information in violation of either a non-disclosure agreement (NDA) and/or Washington State's version of the Uniform Trade Secrets Act, Rev. Code Wash. (ARCW) Sec. 19.108.010 (2001).

Thank you to all of you who have called or sent mailings with information, including those of you who have made anonymous submissions. We are making progress in identifying anonymous posters who have wrongfully defamed HMC to add to our pending lawsuit. Again, if you have knowledge of those individuals that are posting defamatory comments under aliases, please contact us by phone, fax, e-mail, or snail mail.

It appears that one or more disgruntled former employees of Znetix and/or HMC may be the source of some of the defamatory posts. If you have been contacted or received information from a former employee of HMC and/or Znetix with alleged "inside" or "confidential" information, please contact our office with that information as well.

BVSN's SLAPP
by: doe9doe9 08/14/01 04:36 pm
Msg: 166350 of 166453

RE: BVSN's SLAPP

Hi,

On July 25, 2001, BVSN filed a lawsuit, BroadVision v.
Does 1-9, San Mateo Superior Court No. 417698. The
suit is directed against nine Does, based on their
posts on this message board. BVSN's complaint is for
breach of contract, breach of fiduciary duty, and
defamation.

BVSN used this lawsuit to get a subpoena issued to
Yahoo!, seeking identifying information about the nine
Does. Today is the date Yahoo is scheduled to respond
to BVSN's subpoena.

I posted the message for which BVSN is suing Doe 9, so
I guess that makes me Doe 9.

Yesterday, my attorney, from the California Anti-SLAPP
Project, filed a special motion to strike the
complaint as a meritless SLAPP (Strategic Lawsuit
Against Public Participation), under California's
anti-SLAPP law, Code of Civil Procedure section
425.16. When my motion was filed, that automatically
"stayed" (blocked or froze) all discovery in the case,
including BVSN's subpoena to Yahoo as to all nine
Does.

You might be interested in which nine posters BVSN
sued. It may be you!

These are the defendants in BVSN's complaint and what
they are being sued for:
Doe 1: "bv585broadway", for posts on 6/06/01.
Doe 2: "dr_chen_pehong", for a post on 6/19.
Doe3: "smartinv2001", for post #164317.
Doe4: "bvsmgr", for post #164430, on 7/12/01.
Doe5: "early_wave_layoff", for post #163768 on
7/04/01, and for four other posts in early July.
Doe6: "yosemite_april", for posts on 7/05/01 and
7/06/01.
Doe7: "z_to_me", for posts between 7/05/01 and
7/12/01.
Doe8: "belsenb", for posts between 6/29/01 and 7/06/01.
Doe9: "bv405broadway", for a post on 6/21/01

If you're one of the other Does, and would like to
explore the possibility of cooperation in fighting
against this SLAPP, reply to doe9doe9@yahoo.com.

This lawsuit is an attack on all who use this message
board, except for the BVSN hacks/apologists. The
stock price is down, not because of message board
postings, but because of BVSN's own operational
difficulties, such as the $240 million loss in the
latest quarter. Rather than take responsibility for
the stunning decline in BVSN's fortunes and stock
price, BVSN management seeks to "shoot the
messengers". Even if you are not now named in BVSN's
complaint, you could be in the future if you post
something BVSN doesn't like!

For more information about SLAPPs, visit the webite of
the California Anti-SLAPP Project, www.casp.net.

ditto the comment fighting them. don't take shit from wealthy "executives". no wonder so many companies in high tech are firing people, bunch of morons are running the companies.

How sickenly, moronic and pathetic is it that BV management has to go after sometimes useful, sometimes ignoramous message board posters?

Question:
1)What does BV expect to accomplish from this, if it's true?
2)are they suing Greenspan next?
3)Who at BV would initiate such a stupid idea of a message board lawsuit?

The reason why BroadVision is suing those 9 Does is they are telling too much about how BroadVision has been operated and how BroadVision had screwed theirs clients.

BV investors OUGHT to be complaining about why BVSN is paying lawyers (to the tune of $200-$300 per hour) to pursue Yahoo chat board posters...what a flagrant waste of money.
