I wonder if Mr. Monski would have gotten in trouble if instead of canceling his 100 share order (signaling that he really intended to defraud), he allowed it to execute and simply entered a stop loss at the original price of $5.06 on the 100 shares. He would have lost $75 on the 100 but made $375 on the 500 for a net of $300 profit.

Since he followed through on all the trades can a case be made for fraud?
