And I think that part of the reason we have failed so miserably in attacking it was to confuse the two.

Yes, too often the substantive issue of guilt or innocence was lost in procedural issues.

Whoa!! While I would acknowledge judicial abuses, those "procedural issues" are the protections we all have against a totalitarian style government. In the real world, sometimes the bad guys get away with stuff. But that can not be used as an excuse for the rest of us to lose our rights....
