"The current immigration law strongly favors that all applicants apply in their home countries, tourists by definition need to apply for visa outside of the US. The US Congress can come up with any way to process these applications. ... The US have the right to revoke the visa, or not to renew."

I was correcting your misapprehension that the U.S. Constitution only applies to citizens, not commenting on who gets visas or how they are processed.

Jozef,
You wrote:The current immigration law strongly favors that all applicants apply in their home countries...

So, who follow that law?

Three sure ways of getting in 1) Walk across the border or 2) Overstay on your visa 3) Visit this country and hire an attorney when you get here.

This country have basically open borders, but many countries in Europe have the same problem. People from all over this world are moving to the "best" countries on earth...humble carl
