False or misleading advertising is illegal in California and most other states. Here is a fact sheet from the California Department of Consumer affairs.

False and misleading advertisements - An advertisement that is false or misleading is prohibited in California. An advertisement that fails to disclose information or that is ambiguous or is partially, or even literally, true may be found unlawful if the public is likely to be deceived by it. (B&P Code§17500)

There some sections in the California Code that will allow the class action lawyers to file suit against AMD for misleading consumers with the quantispeed ##s, i.e. 1600 + does not actually run at 1600 MHz clock speed. These were the basis for the Pentium Floating Point Divide suits against Intel.
