If you argue it that way, you could as easily argue that it is misleading when Intel says their P4 runs 2GHz - insinuating it is twice as fast a 1GHz PIII (or even more), which it isn't.

But the difference is that it does run at 2GHz.

"Desperate times call for desperate measures"...That they do, but questioning the legality is completely bogus.

I didn't bring up the subject or post the section of the California code but it does seem to fit. It seems pretty clear there is an intent to mislead if not outright defraud. And conspiracy to defraud is a crime as well...
