well it wasn't fair for about 160 years- so it would only be fair to have 160 years of unfairness in the other direction. Of course it is perfectly clear why you might think that is unfair. But almost anything is unfair to someone.

And no, I do not think standardized test are created to be biased, but it is pretty clear they are.
