I just started looking at the questions you raise - just reading an article by Adam Roberts on prolonged military occupation which seems like a good way of looking at the problem - military occupation of the territory of belligerents after the cessation of hostilities. One cannot be expected to give the territory back as long as the danger of conflict remains. Thus, one cannot expect Israel to cease military occupation until the Palestinians quit trying to kill Israelis. After World War II, the Allies occupied Germany for ten years, and Japan for six years, so there is precedent for long occupations. Looking at the footnotes of the article I see that there are quite a few treatises on international law which can be profitably consulted - Chomsky, whatever else he is, is not a lawyer, nor a specialist in international law. The article states "according to International law the exercise of the right of military administration over territory and its inhabitants has no time limit because it reflects a factual situation."
