Who says the constitution is the end all and the be all? I thought you believed everything is relative? If everything is relative then so is the constitution. Inalienable Rights can't be bestowed by a non existent God. If we invented god then we invented rights, and if they are merely convenient constructs then we can just as easily un-invent them.

But that minor point aside I think all bets are off when a country is at war an under direct threat of imminent attack. The McCarthy hearings were a political witch hunt for people who had political and philosophical disagreements. It was not war, and no ones life was in imminent danger. All that and I'm still not advocating physical torture of war criminals, but ..... I wouldn't rule out the use of drugs to coerce information from them to save innocent lives. If some rapist had one of your kids stashed away and you knew it, would you still feel the same about his right to abstain from self incrimination? I wouldn't.
