Then I assume the circuit breaker has to be accessable to reset in the event of the transponder tripping off. The circuit breaker then becomes an on off switch. Or on the other hand if by some magic they make the transponder always on with an inaccessable circuit breaker, nothing prevents me from taking portable power drill right into the face of the transponder, that would F**k it up good.

Having the transponder wired directly to the engines causes further problems, the power off the magnitos would be too unreliable, the power in aircraft always comes off a battery/regulator buss bar for cleaner power.

3rd problem with having an always on system is in the event of normal operations an electrical problem where power needs to be shed, a pilot needs to have an option of which electrical systems to take off line. And if he was in a rural area flying where not concerned about other air traffic he might opt to lose the transponder.

4th there's no rule that says that I have to fly IFR (instrument flight rules) even with a jet as long as I stay below 14,000' and below a certain airspeed, no transponder required under VFR rules. I can get my jet in the air and ATC doesn't even know what I have up there.

Somebody can figure out a way around the system if they put there mind to it.
