JBC you are making this way to hard. What I am saying is that power would be applied to the transponder whenever engine power is up. As there is not requirement for the transponder to be accessible from the cockpit, it should be in some avionics area that is not accessible in flight.

All the rules you quote need to be changed, as if the those swithces weren't available, the sept 11 planes would have never been lost on the ATC screens
