There is no requirement for a congressional declaration of war to indict for treason.

Which was the reason the Rosenbergs were charged and convicted of espionage and sedition because we were not at war with the Soviets at the time. There does appear to be the need for a "declared war" for a person to be charged with treason. The further discussion of aiding the enemy confuses the issue but Constitutional scholars appear to be in agreement that this needs to be a "declared enemy."

Article III
Section 3. Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.


My choice would still be to leave this man in the hands of the NA with all the other prisoners.
