I said he is free to walk in a store and figure out which phone he wants to buy - a low end voice only CDMA2000 phone or a high end CDMA2000 voice and data phone.

So this "consumer" will have his/her research provided to him/her by a "salesperson". During the course of your life experience, haven't you found that at least some salespeople
exaggerate?

He said the division in the wireless market will be driven by low end CDMA2000 handsets and high end voice and data handsets

and I am not disputing that. That makes good sense.

If you think PCS is going to get sued for misleading advertising because of differnet layers of marketing for 3G products, you are entitled to your opinion. I couldn't give a flying duck.

If that is your opinion, fine. My point is that the average "Joe Six Pack" who has heard of "3G", most likely, has envisioned high speed data services. With the "3G" label affixed to these cell phones and if that is their idea, they will be greatly disappointed.
