Somebody from MSFT was on CNBC yesterday discussing the conference call and they specifically stated that the earnings charge was for the cost of the civil case including the settlement. He said even though the judge rejected the deal, accounting practices required that it be stated on the earnings.

John, you've got that right! The legal expenses that have resulted from the necessary prosecution of Microsoft's antitrust violations has taken, and will continue to take, large tolls on the tech sector, on Microsoft shareholders, and on government budgets.

Don't expect this to stop any time soon unless an effective remedy can be crafted that will prevent them from continuing to abuse the law.
