1.The states did not create the federal government in the sense of subscribing to a treaty. "WE the people of the United States, in order to form a more perfect union....." created the federal government, which was why there was specific provision in the 10th Amendment about reserving powers to the states (it was not automatically implied). It is true that secession was contemplated by the Hartford Convention: obviously, rebellion against perceived injustice was not ruled out by a regime born out of revolution. I am not arguing that there was no moral right, depending upon cause. I am arguing that, absent a mechanism, there could not per se be a legal right to secede.

Skipping to 3. The point is that claiming a moral right does place some onus on the party breaking the tie to adduce sufficient provocation, especially if the evil of war will be called down.

4. The motivation for secession was slavery, a damnable institution, and one that made a mockery of the ideas of the Republic. It is laughable to talk of states rights when one will not uphold the right of the slave to live in peace with his family around him, but will allow children to be sold away from parents and wives from husbands. Does a state have more rights than a human being?!

5. Yes, the South is largely responsible for the federal Leviathan, not only because of the Civil War, but because of its ignoble behavior over integration. At some point, setting dogs and firehoses against church ladies exercising their Constitutional right to march, or failing to convict murdering scum like Beckwith (the fellow who killed Medgar Evers) was going to discredit states rights, and we are fortunate that we can talk out all about the New Federalism........
