There was no declaration against Afghanistan, only the Al-Quaida network.

Me either. It seems we are at an impasse. I expect some new terminology to be forth coming. We can't simply say that no uniforms designates a status. That would have made the minute men of US history terrorists, when in fact they simply didn't have the funds or cause to purchase formal uniforms. At the same time we should have some rules of treatment regarding prisoners who've engaged in terrorism or we are left with authorization to perform inhumane acts at the whim of those empowered over the prisoners. For the moment there are plenty of watch guards over this but in the long run we definitely need some rule of law in place.

I don't believe we recognized the Taliban as the legitimate government of Afghanistan. Only a few countries did. Add their complicity with Al-Quaeda and their status becomes even more illegitimate. We did not attack Afghanistan, we sought the perpetrators of the 9-11 attack and their allies. As far as we were concerned the legitimate government of Afghanistan was on board and present circumstances bear this out, ....no imperialism there.

The rule of whim you state is military tribunals for illegal combatants, a class described as not covered under international law in the Geneva Convention. It is a course not without precedent. The bad precedent was flying planes full of civilians into a building occupied with civilians. Hard to see these civilians as illegal combatants.
