That IS interesting..

The bottom line is that in prior times, such terrorists were hung, often without benefit of a trial.

The Germans regularly hung or shot Soviet partisans, despite their being members of a resistance force.

And when the US set up the Contras, they took great pains to ensure that its members were in an identifiable uniform, and thus entitled to the benefits of the Geneva convention. However, that didn't stop the Sandinistas from shooting them, or putting them on trial as illegal combatants and denying them POW status.

These "rules of war" were established to try and limit the wanton and indiscriminate killing that had occurred previously. Obviously it was not perfect, not strictly adhered to at all times, but like so much of international law, parties only feel bound to accept those items that benefit them.
