tejek,

Considering the Constitution of several if not all States say that individuals have the right to own guns and they probably used the US Constitution as a guide - how is it you suppose they screwed up. They should have said the right was meant to be collective right and not an individual shouldn't they?

Ted the militia was individuals with their own guns who where called up by the state, not a state army. If you prefer current law to history and original intent, then look at the federal law about who is a member of the militia. I think you are a citizen and not a felon. If you are also between 18 and 45 then you are a member of the militia.

Yes there was an issue of increasing the ability of the states to counter the federal government, because if individuals where allowed to own guns then the states could call them up to form a militia.

Many gun control supporters like to claim that the militia consists only of the national guard, but in addition to the fact that US law and historical practice invalidate that claim, the claim also doesn't fit in with the idea that the 2nd amendment is for purely state controlled militias. The national guard is largely funded by the federal government. Its training is done by the federal government. Its members can be called up to active duty by the federal government at any time.
