Well, the article makes the case that he was no more competent (sane) than she was.

"A rationally thinking man would not foist the home-schooling of five children on a woman like Andrea Yates. A rationally thinking man would not leave five young children alone with her."

He was not rational and therefore cannot be legally responsible for her actions.

Don't get me wrong, I think the guy is a nutball and an irresponsible parent. But I do not believe he is legally responsible for his actions.

The fact that he is controlling only indicates that she wanted to be with a controlling person.
