If you were familiar with the history you would understand that the power marketeers and the IPPs had effectively boxed out the PUC and were only controlled by the FERC, which they conveniently had in their back pocket. For a long time, until the moral outrage, and the pocketbook ethics of Republican businessmen in California who were getting burned by the Texas brothers was just too intolerable, the FERC wouldn't raise a finger on behalf of the consumer. The crooks were running the racket, and had bought off their only regulators.
