I agree, I cannot see anything that could justify rape. I can see "better and worse", though. For example, use of a weapon would be worse. In the instance I was thinking of, I would say that there is justifiable homicide, within narrow circumstances, and that unjustifiable homicide is called murder or manslaughter, depending upon rough levels of culpability. Perhaps the analogy would be "rough sex": within certain limits, and assuming consent, "assaultative sex" is okay.......
