I was extrapolating the business about alcohol and lack of express consent from existing definition of date rape.

In the core study itself, 73% of the alleged rape victims thought they had not been raped. 42% had sex with their alleged attacker again. Now, it appears to be the case that some force was used, although it is unclear if it were mere aggressiveness or a real physical threat; and it appears to be the case that most of the women protested the direction of events at some point. On the other hand, it is not clear whether that indicated ambivalence or stronger protest. Most guys have had the experience of having the girl express reluctance, perhaps because she had some homework (these interviews were in a college setting), and yielding to greater ardor, where there was no question of real physical threat, and where there was no question that the guy would cease if she put her foot down.
