It is really funny to see the citadel of free enterprise, capitalism, competition and all that hypocritical cant putting tariffs on steel, banning New Zealand sheep imports and treating cellphone and other telecommunication services in a similar way to the USSR's Kremlin's approach to economics.

It's time for open slather in telecommunications. There is no need for price plans to be submitted to the FCC. There is no need for spectrum ownership restrictions. There is no need for humans with gender advantages getting special spectrum bidding privileges. Being testosterone-rich is not much compensation for being spectrum-poor. Nor should melanin-rich people be given special privilege to become spectrum-rich as well, at the expense of the melanin-deficient. Senator Hollings is a joke and so is Congress.

There's no need for geographic restrictions in spectrum ownership. Nor is there any need for market capitalisation or other financial definition of companies into "small" or "big" and therefore to be given special privileges to own spectrum and supply services.

The FCC is part of giant kleptocracy. Now that they have $$billions swishing around, the drool and spittle is flying as greedy bureaucrats and those seeking preferential treatment struggle to get their greedy paws on the cash flow.

In a way, it is as well that the telecosmic boom collapsed as things were getting hysterical and vast waste was everywhere. Now people are having to earn their dollar and the FCC, tax people and government officials can't presume to collect the biggest ransom in human history. Enron won't be making more political donations. Global Crossing is history. Worldcom and the other participants in speculative mania are struggling for survival.

It's time for open competition with no ownership restrictions.

<According to my calculation and FCC documents. LWIN Leap has increased their total revenues and assets beyond the Commission's Very Small Business financial thresholds. But, are still qualified as an Entrepreneur and eligible as a Designated Entity !

This prohibits LWIN ability to acquire new spectrum in Entrepreneur Blocks C,F without "unjust enrichment penalties" payable to the FCC! Much of the non-Entrepreneur block spectrum is held by "real telecom compaines"! This will severally limit LWIN's future growth potential beyond current holdings, and Auction 35 wins if they are ever conveyed!

What is the cost of the penalties as compared to the value of any additional spectrum needed to go beyond the 40?

If limited to the 40, what strategy would you think appropriate for 3G? How would that play out?
