Well, of course, that is the argument: whether the lack of recognition of gay marriages causes discrimination.

I'm not sure what you're getting at with the 'third type of human' bit.

If you enjoy collecting stamps, should you're rights be protected? What if there was a law that said "Philatelists can't claim exemptions on their tax return"? Would that be violating the Constitution, and thus worth fighting?
