It makes sense, alright, but if carefully analyzed it is not "fair". Remember that when this case first started the Department of Justice used it's influence to encouraged the states to file simultaneously. This creates an atmosphere where the poor defendant is overwhelmed.

The DOJ got the European Union all fired up also. Of course the joke here is that all that happened is that GE got blown out of the water in its attempt to merge with Honeywell.

Now some would say that the GE merger would have been good for the US at perhaps the minor expense of the European Community...

and in that case, you might be right in that "it doesn't make sense".
