They were investigating Tony months BEFORE the Phoenix memo stuff came out. Puhleeze use yer head.
Were they supposed to NOT bust him after they found he was receiving info on the investigation? "Hey guys, we gotta lay off this bust or it'll look like we're trying to make up for Phoenix".

I think you need to read the RICO manual for Federal Prosecutors.

Just answer these two questions:

Did Tony tell his subscribers that he was getting information from the FBI or any other governmental agency?

Did some of his subscribers trade on that information?
