Different matter. They are only invoked because of the "inter-state commerce" regulating authority of the Federal Government.

A.D. Ashcroft could find no federal murder statute to invoke regarding Oregon's Assisted Suicide Law... and believe me, he looked for one.

The only weak claim he tried to assert was rejected in Federal Court.

It's is a matter for State's Sovereign Power.

(You know, that 'State's Rights' thing the Reagan Revolution said it was all about).
