There are a whole plethora of excuses the Feds could invoke, Medicare, Medicaid, federal drug laws probably even some Constitutional stuff if you wanted to get creative.

BTW, I don't believe this is an area the Feds should try to regulate. I don't agree with the DOJ position on this one.
