In fact, the FBI wants a list of all who have received scuba diving certification in the last two years and has already gotten that info.

There is something else to remember

Technically, once you have unlimited electronic review over the internet ... it isn't difficult to develop a rationale for "internet" based scan of all data provided by a non-FBI web-cleaner server that just happens to be fed any number of lists. Such a site can be driven by a "Back Orafice" type virus/trojan horse, to capture your personal desktop PC data, email, passwords, keystrokes. You could also use the FBI's Magic Lantern, since authorization is non-specific and automatic.

What would the legal position be?

Answer: Complete access + complete deniability

I.e., Big Brother Nirvana ... completely automated scanning of digitized thoughts of all connected Americans, without recourse.

Now the only remaining piece of that puzzle is how to use that data in court... Perhaps what happened this week allows "inadvertent" material to be used in court that is later decided to be criminally relevant.

If so, this would mean you, as a political enemy, could be watched constantly for anything that may be deemed actionable, the evidence admissable, and you convicted, hoping they didn't manufacture any of it to get rid of a political nuisance.

It's the kind of fishing expedition classicly denied under due process.

I don't know h ow to santitize this country of terrorist actions (other than getting the hell out of foreign military adventures), but this latest move is basically saying we need martial law.
