I don't think the government has much of a choice in this matter. They have two FBI agents providing information to a private citizen from the FBI data base. This isn't FBI policy. If they fail to act you can imagine how the civil liberties lobby will howl with derision.

I believe this 'childhood defense' idea isn't going to work. I think the argument is that if the FBI guy was a complete stranger we would all agree that it was a bribe, but since it was a childhood friend we must assume that it was only a loan. A bribe is a bribe is a bribe. If the 'loan' was given with the expectation of Anthony getting something in return then it was a bribe.

In this respect the question of whether or not the information was publicly available elsewhere is irrelevant. If it was obtained inappropriately from a government agency that is legally mandated not to release information to the private sector then it is a crime.

Also, you seem to have forgotten about the allegation that Anthony attempted to extort money from certain CEO's. Do you suppose they were Anthony's childhood friends too? Would it make the extortion charge less valid if they were?
