Man is not perfectible. Society is not perfectible. We're stuck with having problems in both. There have been murders stretching as far back into the past as we have records. There will continue to be.

It is a huge bureaucracy that is heavily politicized so it is not going to change just because its a good idea.
The federal judiciary is fairly well insulated from politics. State judiciaries (which handle most of these cases) vary on a state-by-state basis.

Of course the other issue is whether or not we can with absolute assurance identify the perpetrators of heinous crimes. So far, we do not have a record of having done so.
This is improving. I would favor a law REQUIRING the state to do DNA testing whenever such evidence is available.
