If Spitzer is so righteous, why did Spitzer let Merrill off with a financial penalty? Why didn't he file criminal charges?

I think it is reasonable for Purcell to try to avoid having his company pay the price for Merrill's specific wrongdoings. Obviously, Morgan Stanley should pay the price for its own wrongdoings, but not Merrill's.
