You are being unusually dogmatic today.

Sorry, don't mean to. Perhaps, in part, a reaction to your absolutism over the potential for a different approach. Also, perhaps, because I have some enthusiasm for this subject. I really think our system of justice is terribly lacking and that the problem is not being discussed in any useful way. And perhaps because I was subconsciously trying to jolt you a bit to get out out of your box and get a creative discussion going.

If your end is a just society, then my end is minimizing damage due to crime. You want to make sure that people get punished for their crimes, it seems, and I want to reduce the incidence of crime and to make the victims as whole as possible.

OK, I'm not going to come up with a replacement for our system of justice in an afternoon, but I've been noodling about and have a starter outline. This is a work in progress.

Outline of Objectives

regarding the crime in question
-the criminal
....accountability/conviction
....make amends
....rehabilitation
....protect society from future actions by this perp
-the victim
....made whole, receive reparations
....validate loss

regarding society at large

--deterrent for similarly situated prospective perps
--make statement of societal values

relevant instrumental values
--punishment fits the crime
--not profiting from the crime
--mercy and justice

You'll note that your overall goal is one of my instrumental values.
