The best thing would probably for the full 9th to reverse the 3-judge bench.

The longer this goes on, the more I think it might be interesting to see it play out longer than that. I'm on record as preferring that the bozo not have started this action in the first place, but now that the deed is done and the country has already erupted...

That's the likely outcome, if the panel itself doesn't reverse itself on reconsideration.

From a legal point of view, I think the decision was not only wrong, but also that the issue is de minimus and should have been dismissed when initially filed.

De minimus non curat lex. (If my spelling is right -- my Black's is still packed away.)

The 9th Circus Court of Appeals is not likely to reverse the decision, IMO.
