First, it's generally not about giving up complete rights, but of a degree to which they are curtailed.

Seems, though, that you need a matrix. How many deaths, for example, would it take in order to allow the government to listen in on international telephone calls without a warrant? How many deaths in order to do random stops and searches of passengers on Amtrak trains. Etc. A rather gruesome exercise, but necessitated if one takes your approach.
