It seems to me more like saying that the default position is respect for authority as ultimately deriving its legitimacy from God.

You're right, we don't have any context but the Post editorial. My impression from reading that is that Scalia thinks the legitimacy of our government comes from God rather than the consent of the governed, which I find very disturbing. IMO, our government has authority because you and I grant it that authority. Period.

[Regarding the eighth amendment, I don't have a problem with where he comes out on that. While I do not think that cruel and unusual is not irrevocably tethered to the eighteenth century, I do not care for what the court considers current social consensus.]
