The problem is in concluding that an American has "decided to go to war against America" without any Constitutional safeguards.

John Walker Lindh will be out of prison in five years. Then he'll make a ton of money by appearing as a guest on Bill "Outrage" O'Reilly's show. Hell, they'll even do a mini-series on his life.
