No, the ultimate arbiter of that debate would have been the membership of the Supreme Court in the 80s. Got your decades wrong, CB. I had anticipated your reply would be something on the order of Reagan would not ask for Supreme Court review because the members of his administration assumed he would lose, given the membership on the court.

Which is how we decide, unfortunately, given the membership right now, what is constitutional. We let them (s)elect presidents.
