IF one gets the opportunity to be presented to a Court (hopefully with a representing attorney)

The Executive (in this case DOJ) tests the limits of that power and the Court is there to maintain the balance. Our founding fathers were brilliant men.

Yes, but it would have been much better to have the cabinet position most responsible for "justice" to have seen the constitutional problems at the outset. And it would have been even better for members of congress, who certainly know better, to have been explicit and public with their criticisms.
