Jose Padilla is an American citizen! Tell me why he's getting Ashcrofted and Goldstein isn't.

Does Goldstein belong to an organisation that has declared war on the US?

BTW...I'm not sure I agree with Padilla's treatment. If my understanding is correct, the Bush administration has unilaterally decided to hold him without charging him. At the LEAST, they should be required to bring the evidence before a judge to be able to hold him.

However, there is a difference between Goldstein and Padilla.

Padilla is being held indefinitely without charges because he is considered to be an enemy combatant. One loses one's constitutional rights as a citizen when one becomes an enemy combatant. Ex Parte Quirin 317 U.S. 1 (1942), the Nazi saboteurs case. At least one of the defendants was a US citizen.
