It is defined in the founding document of the United States because it was so abused by the English kings. Any expression of disagreement with them or their ideas was chargeable with treason. Treason is a charge that is very easily abused. Right now, questioning the wisdom of invading Iraq could be charged by the gov't as treason- -were it not for this:Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. Treason is a political expression about the govt and what it stands for. It is advocating an overthrow of the govt to which the offender owes allegiance. Advocating violence is generally illegal. If you attempt to incite a mob to lynch me, you have committed a felony. If you plot to blow a bank vault and steal the money, you can go to jail- -just for that, with no action. If you make a credible threat against me, you can be charged with assault. OTOH, if you say I am a cretinous idiot and jerk who needs a guide dog to find the door, but make no threats, you're in the clear. If you claim the US, through its sanctions against Iraq, is starving innocent Iraqi children and depriving them of needed medicines and burn a flag to express your disgust with the policies of this country, you have committed no crime.
