The corporate behavior cited by Tiger Paw is not an isolated instance. I am presently litigating an appeal to the Washington State Board of Industrial Insurance Appeals in an attempt to force a self insured employer to pay for a cervical spinal fusion which was performed and did, in fact, improve my clients injury related condition. I can tell you from first hand experience that such conduct is widespread. Furthermore, if the employer contributes to the health plan, the employee is forced to sue in federal court, not state court.
