I used the word assault for that reason. The FISA was put into law because abuses did occur. There were protection mechanisms built in through the FISA to make reasonably certain that they would not happen again.

The Constitution is not based on any principle of trust. It's based on distrust. The checks and balances, the way Congress is constructed, the Supreme Court Justices as not elected officials [to not be influenced by the public]. Appointees approved by Congress, veto power, the ability of the Senate to override a veto, the intended weakness of the Executive ...these are all based on complete and utter distrust of government.

You missed the 10th, Congressional oversight and Judicial review.
