The checks and balances, the way Congress is constructed, the Supreme Court Justices as not elected officials [to not be influenced by the public]. True but the claimed violations (at least most of them) where not violation of the constitutional checks and balances but of later legal ones. They are not unconstitutional because they go against later federal law not the constitution, they are not illegal because the newer law supercedes the older law. They may (and I'd probably agree some of them are) a bad idea. I'm not really supporting the law, certainly not the whole thing, but rather saying that at least most of it is constitutional. As for the 10th you have a point but the whole federal government has pretty much ignored the 9th and 10th for a very long time. Amendment IX The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Amendment X The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. A strict reading of these amendments might result in half of the federal government being ruled unconstitutional. A very good response though, my compliments. Thanks. Its nice when people can disagree so strongly but remain calm, polite and rational and actually pay attention to what the other person is saying rather then being set off by a particular phrase and go ballistic on it while ignoring the point of the post.
