Thomas Jefferson waged war against the Barbary Pirates without benefit of a formal declaration of war, and it was deemed acceptable........

There was no State involved to declare war against. Plus we've done all sorts of things in our history that were deemed acceptable. We interred Japanese Americans during WWII, that was deemed acceptable. In fact, Ashcroft cites it as precedence.

"Considering that Congress alone is constitutionally invested with the power of changing our condition from peace to war, I have thought it my duty to await their authority for using force in any degree which could be avoided." (Message to Congress, 1805.)

The Executive always wants greater authority, even Jefferson changed his tune once he became President. He had other contradictions as well. Exceptions aside, the constant expansion of Executive Branch authority undermines the Republic to the point where we have had large secret police throughout DOD and other branches for several decades now, meddling in both foreign and domestic affairs without accountability. This was not forseen by the Founders, and is un-American insofar as it subverts the other elements of the Constitution. The result is the inevitable formation of an all-powerful central government, which can subvert without disclosure any part of the Constitution without challenge by Congress or judiciary.
