"I would not insist on proof beyond all reasonable doubt but I think it should be solidly established. " Pickering is being hired for a job.......a position as judge. I don't know about you but I try to get the best person possible for a job. If there are questions, and they can't be answered, I go to the next candidate. This approach is very common in hiring. Pikering is facing a political process. He is being smeared because the democrats want to avoid conservative judges. If there were solid questions about him in this area he would have little chance of being nominated and no chance for confirmation. But some of the democrats in congress or in certain special interest groups will find something, real or not, to smear any conservative with unless he has almost no record, in which case they will attack him for being inexperienced.
