Here's that difference: You're doing 40 in a 30 zone. You enter an intersection with no stops signs, hit another car, and someone is killed. You'll probably be charged with speeding, an infraction, and it'll be called an accident. No jail time.

You're doing 105 in a 30 zone. Same intersection, same result. You will probably be charged with vehicular manslaughter, a felony, and go to prison.

The difference is that 105 is clearly reckless endangerment of other people and any reasonable person knows it. Although you didn't intend to kill anyone, you did and such a consequence is reasonably predictable from your actions. You intentionally did not exercise the caution required when operating a couple of tons of powerful machinery.

96 people are dead and nobody intended for that to happen.
But it was reckless to use spraying fireworks inside a building with lots of inflammable material about and any reasonable person knows it.

Its hard to view either the band members or club owners as murderers.
Unless something else comes to light, they won't be accused of murder. Murder requires premeditation and intent. They will be accused of manslaughter which does not require intent.
