I see where you are trying to go. But you cannot get there from here. You see, the two sets you've mention differ radically. One was a mere opinion made by one party to a nation that may or may not have needed it at the time. We really do not know the intent of the person who gave it. And we do not know if it was the will of the United States. Though perhaps it was helpful, it was non-binding and offered as a mere suggestion.

The other was made after years of deliberation and agreement between very many parties who represented the United States. It became the known will of the country. It then was structured in such a way as to codify this known national will into law. It aimed to preserve FOR PERPETUITY the essential American way of life via Contract.

That is why many argue the essential intent of the latter set ought not change.
