"Merrill neither admitted nor denied wrongdoing. The firm said last month it would also consent to an injunction barring it from violating federal securities laws under the deal."

Geez, how many times does Merrill have to bribe the government to avoid criminal charges? They should suffer the same fate as Arthur Andersen.

If I shoplifted a $20 CD and got caught, who should I approach if I want the following to occur?

1. I'd like to keep the CD
2. I'd be willing to pay a small fine but much less than the value of the CD
3. I am allowed to deny that I did it
4. I will not be charged with an offense
5. I am willing to promise not to do it again

I guess I'll have to phone Merrill to find out.

And the SEC wonders what happened to investor confidence.
