It doesn't ban anyone from anything. They can decide if they want to work at a location where they would be uncomfortable or if they choose not to work there.

No on has a natural right, or IMO should have a legal right, to have a specific job, let alone to have the job and impose conditions on the employer. If the potential employee and the potential employer can't come to an agreement on the working conditions then they should each look elsewhere.
